Terms of service

Fides Identification Limited · effective from 1 October 2026 · version c7f61704d5cc

Who we are and what FIDES is

These terms are an agreement between you and Fides Identification Limited (NZBN 9429053923899), trading as FIDES ("FIDES", "we", "us"). They take effect on 1 October 2026. By creating an account or using FIDES, you agree to them.

FIDES is a reference and verification network for people who hire carers in aged care, childcare and disability support. We verify identity, collect structured references from the people who have engaged a worker, and show them, with the worker's consent, to organisations and families who are hiring.

FIDES is not a marketplace, an employer or a recruitment agency. We don't place workers, decide allegations, or tell anyone whether to hire someone.

These terms include our Privacy Policy, Worker Consent Statement, Referee Notice and Safety Concerns, Disputes and Exclusions Policy.

Accounts

  • You must be 18 or older.
  • Give accurate details and keep them up to date. Workers must register with their legal name and date of birth exactly as on their ID, and complete an identity check before their record can be found.
  • Organisation accounts need a valid NZBN, which we check before the account can search or request anything. Family accounts don't need one.
  • Each organisation account is one login. Don't share it, and tell us straight away if you think someone else has used it.
  • You're responsible for everything done through your account.

Organisations and families

Giving a reference

When you submit a reference or answer a reference check, you confirm that:

  1. you, or your organisation, actually engaged the worker;
  2. your answers are based on your own records or direct knowledge;
  3. you've answered honestly, and marked each answer correctly as documented fact or an informal account;
  4. you're not acting out of ill will, or to gain an advantage over the worker.

A reference counts toward a worker's record only once the engagement is confirmed. You are responsible for the accuracy of what you submit.

Using what you see

What you see about a worker on FIDES is for one purpose: deciding whether to engage that worker for care or support work. You agree to:

  • show it only to the people involved in that decision;
  • not copy it into other databases or share it with anyone else;
  • not search for anyone you aren't considering engaging;
  • handle it in line with your own obligations under the Privacy Act 2020.

FIDES provides parts of a safety check, not all of it. Your own legal obligations, including under the Children's Act 2014 and your sector standards, stay with you.

Workers

  • Declare your full employment history in care and support work, not a selection of it. We check it against the source documents you provide, and every employer on it is invited to give a reference.
  • What you consent to, and how to change it, is set out in the Worker Consent Statement. You decide who sees your record, but not which parts of it.
  • A Verified profile lasts 12 months from purchase. A profile's figures reflect only the references completed when it's viewed. We can't make an employer respond, or make them respond by a set date.
  • You can reply to any safety concern raised about you and ask us to correct factual errors, as set out in the Safety Concerns, Disputes and Exclusions Policy.

Acceptable use

Don't use FIDES to:

  • harass, threaten or locate anyone;
  • discriminate against anyone on a ground prohibited by the Human Rights Act 1993;
  • submit a false reference, or a reference for someone you haven't engaged;
  • report concerns about a worker you haven't been asked to give a reference for. FIDES isn't a reporting line. Take those concerns to the worker's employer, the relevant sector body or NZ Police, and call 111 if someone is in immediate danger;
  • impersonate anyone, or use someone else's account;
  • get around our access rules, scrape the site, or search in bulk.

Prices, payments and refunds

  • Current prices are on our pricing page. They are in New Zealand dollars and GST-inclusive. Card payments are processed by Stripe; we never see your full card details.
  • To view the record of a worker you're considering engaging, an organisation or family needs the worker's authorisation and an active Hiring Pass. An HR subscription or Family subscription covers only workers currently engaged by you, and doesn't give access to anyone else's record. A Hiring Pass shows the worker's references from past employers and their verified employment history, and nothing more. One-off checks are charged on top.
  • The HR subscription lets you see the records of workers on your team and log incidents as they happen. It's charged monthly for each worker on your team. You can cancel at any time; it ends at the close of the month you've paid for.
  • We can change prices. A change won't apply to anything you've already paid for, and we'll give you 30 days' notice before a change affects a subscription.
  • Some add-on checks are done by hand and take time. If the institution we check with charges its own fee, we'll confirm the amount with you before going ahead.
  • Refunds: if you haven't viewed a profile with it, a Hiring Pass can be refunded within 7 days of purchase. Once a check has started, it's generally not refundable unless we haven't delivered what you paid for, or the law says otherwise.
  • Checks not yet available: we don't sell Ministry of Justice criminal record checks or Police vets yet. We'll take payment for them only once we can provide them.

Safety concerns, suspension and exclusion

Safety concerns raised in references are reviewed by a person before they form part of a record. The Safety Concerns, Disputes and Exclusions Policy explains how review, replies, corrections and exclusions work.

We can suspend or close an account that breaks these terms, gives false information or misuses the platform. Unless there's an urgent safety or security reason, we'll tell you why first and give you a chance to respond.

Where there are serious grounds, we may permanently exclude a worker. The decision is ours, made after review. The worker is told the reasons and can respond before it takes effect.

What we don't promise, and our liability

We verify what we can and report it accurately. We don't guarantee that a worker with no concerns on record is safe to engage, or that a worker with a concern is unsafe. That judgment belongs to the organisation or family hiring. We check that a reference came from who it says it came from, but we don't independently verify a referee's opinion.

If you use FIDES as a consumer, for example as a family or as a worker, nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.

If you use FIDES for business purposes, as an organisation does, you agree that the Consumer Guarantees Act doesn't apply, and that this is fair and reasonable. To the extent the law allows, our total liability to a business user is limited to the fees it paid us in the 12 months before the claim arose, and we aren't liable for indirect losses such as lost profits.

Ending your account, changes and disputes

Closing your account. You can close your account at any time from your dashboard or by emailing us. We keep some information after that, as set out in the Privacy Policy.

Changes to these terms. We'll give you 30 days' notice of any change that materially affects you. If you keep using FIDES after the change takes effect, the new terms apply. If you don't agree, you can close your account before then.

Disputes. Contact us first and we'll try to sort it out. Consumers can also go to the Disputes Tribunal.

Governing law. These terms are governed by New Zealand law, and New Zealand courts have jurisdiction.
